Lietuvoje sudaromų kolektyvinių sutarčių turinys: teisiniai aspektai

LTStraipsnyje analizuojamos atsitiktiniu būdu atrinktos įvairiais lygiais, skirtinguose sektoriuose (privačiame ir viešajame) ir veiklos srityse sudarytos kolektyvinės sutartys, teisiniu aspektu vertinamas jų turinys ir dėl jo pateikiamos apibendrintos įžvalgos. Jame pabrėžiama kolektyvinių sutarčių norminių sąlygų reikšmė, užtikrinant efektyvų kolektyvinio sutartinio darbo santykių reguliavimo metodo įgyvendinimą, atskleidžiamas įstatymuose įtvirtintas teisinis reguliavimas, turintis įtakos kolektyvinių derybų skatinimui. Straipsnyje konstatuojama, kad Nacionalinės kolektyvinės sutarties turinys indikuoja apie tai, kad dėl šiuo metu galiojančio įstatyminio viešojo sektoriaus darbuotojų darbo apmokėjimo reglamentavimo Vyriausybė, kaip kolektyvinių derybų dėl nacionalinės kolektyvinės sutarties šalis, neturi realių įgaliojimų derėtis dėl viešojo sektoriaus dirbančiųjų darbo užmokesčio. Šakos kolektyvinių sutarčių turinys atskleidė netolygų socialinės partnerystės mastą atskiruose sektoriuose, šio lygmens kolektyvinėse sutartyse gausu informacinių sąlygų ir deklaratyvių nuostatų.Tirtų darbdavio lygmens kolektyvinių sutarčių turinys atskleidė, kad juose aptariami klausimai, reglamentuojantys pagrindinius darbo teisės institutus, jose daug informacinių sąlygų, pasitaiko deklaratyvių nuostatų, tačiau beveik nėra neaiškių teisinių formuluočių ir akivaizdžiai "apsimestinių" nuostatų, kurių buvimas stebėtas 2007 metais atlikto tyrimo metu. Siekiant stiprinti socialinį dialogą viešajame sektoriuje, įstatymų leidėjui siūloma koreguoti šiuo metu galiojantį teisinį reguliavimą dėl pareiginės algos (atlyginimo) bazinio dydžio nustatymo nacionalinėje kolektyvinėje sutartyje, įtvirtinant taisyklę, pagal kurią nacionalinėje kolektyvinėje sutartyje sutarus dėl pareiginės algos bazinio dydžio, tuo pačiu klausimu įstatymas nebebūtų priiminėjamas. ENThe article analyses randomly selected collective agreements of various levels, concluded in Lithuania in different sectors (private and public) and areas of activity, evaluates their content from a legal point of view and provides generalized insights of it. It emphasizes the importance of the normative conditions of collective agreements in ensuring the effective implementation of the method of collective bargaining regulation, and reveals the statutory regulation, which influences the promotion of collective bargaining. In the opinion of the author, the content of the National collective agreement indicates, that because of the current statutory regulation the Government of the Republic of Lithuania, as a party of the collective bargaining in national level, does not have a real power to negotiate the remuneration of public sector employees. The content of the branch collective agreements has a lot of informational clauses and declarative provisions. The analysis of the selected branch collective agreements reveals that the quality of social partnership in each separate sector differs. The content of the examined employer-level collective agreements revealed that they deal with issues regulating the main labor law institutes, contain many informational clauses, declarative provisions, but there are no vague clauses and obviously “fictitious” provisions, which were observed in the 2007.In order to strengthen social dialogue in the public sector in national level, the legislator is proposed to adjust the current statutory regulation on the determination of the basic amount of the official salary (salary) by establishing a rule according to which in case of successful collective negotiation there were no need to adopt a special act on the same issue.
