Summary / Abstract:

LTŠio straipsnio tyrimo objektą, jo analizės kryptis ir tikslus padiktavo Vilniaus universiteto kartu su Neapolio Federico II universitetu, Vrje Briuselio universitetu, Liublijanos universitetu ir grupe kitų Europos universitetų bei ne pelno siekiančių asociacijų vykdomas tarpšakinis mokslinis ir eksperimentinės plėtros projektas „Conflict Resolution with Equitative Algorithms (CREA)" (liet. - „Konfliktų sprendimas panaudojant sąžiningo paskirstymo algoritmus"). Pagrindinis šio projekto tikslas - į teisines procedūras pradėti diegti naujas sąžiningo paskirstymo algoritmais pagrįstas priemones, kurios būtų skirtos šalių susitarimams pasiekti. Šios priemonės galės būti naudojamos tokių profesionalų kaip advokatai, notarai, teisėjai, mediatoriai ir betarpiškai pačių ginčų šalių. Ginčų sprendimo srities algoritmizavimo tyrimų Lietuvoje dar nebuvo adiekama. Siame straipsnyje taikomi tarpdisciplininės analizės metodai bei teisės mokslo sisteminis, loginis ir lyginamasis tyrimo metodai. [Iš straipsnio, p. 112]

ENThis article, using interdisciplinary analysis and legal science methods, analyses the phenomenon of algorithmization (computational justice) of property division disputes in the field of modern law science and practice. This is the first attempt in Lithuanian legal literature to look at the process of property bargaining going beyond the legal paradigm boundary. The study of the article is carried out in two directions. The analysis of the existing level of progression of algorithmization of resolution of property division disputes, problems of integration into legal processes, development goals and potential. It also discusses the major development challenges and possible solutions. It is concluded that algorithmization of asset allocation would allow to achieve significant positive goals. For example, the recognition and application in the theory of law and in practice of scientific achievements in other fields by increasing the speed, quality, sensitivity, satisfaction and effectiveness of asset sharing, increasing the dissemination of social peace priority, reducing disputes, and so on.Existing fair allocation algorithms do not yet have legal procedural and content (substantial) legitimacy elements. It limits the possibilities for their application in legal practice and recognition in positive law in pure form. In order to overcome "these obstacles, the application of existing algorithms to legal processes or the creation of new algorithms - adaptation, incorporating substantive legal and procedural legal elements into them - should be performed. The article also identified the main potential problems of the legal dimension that could arise in course of algorithmization of property division disputes and cleared the guidelines for their solution. The subject of this article research, the direction and the goals of analysis were dictated by the interdisciplinary research and development project „Conflict Resolution with Equitative Algorithms (CREA)" which is being implemented by the Vilnius University together with the University of Naples Federico II, the Brussels Vrje University of Brussels, the University of Ljubljana, and a group of other European universities and non-profit associations.
