Policijos veiklos kontrolės turinio problemos : struktūrinis aspektas

LTStraipsnyje konceptualiu lygiu nagrinėjami pagrindiniai policijos veiklos kontrolės komponentai, jos samprata, kontrolės turinys bei pateikiama subjektų, įgaliotų vykdyti policijos veiklos kontrolę, sistema. Valstybėje ir visuomenėje vykstantys politiniai, socialiniai ekonominiai, informaciniai technologiniai procesai reikalauja, kad policija ir jos institucijos peraugtų į aukštesnį teikiamų socialinių paslaugų kokybiškumo lygį. Tai galima pasiekti darniai funkcionuojančiu policijos veiklos kontrolės mechanizmu. Straipsnyje keliama kontrolės, kaip vieno iš teisėtumo užtikrinimo policijos veikloje būdų, problema. Kontrolės reikšmę policijos veikloje lemia keletas aplinkybių: pirma, policija savo veikla apima plačiausią visuomenės saugumo užtikrinimo infrastruktūrą (t. y. žmogaus teisių ir laisvių apsauga, viešosios tvarkos palaikymas, įvairių teisės pažeidimų prevencija ir pan.), antra, policijos institucijos ir pareigūnai, įgyvendindami valdingo pobūdžio įgaliojimus, įgyvendina teisės taikomąją veiklą, trečia policijos institucijos ir pareigūnai turi plačius įgaliojimus taikyti administracinio poveikio priemones visuomenės nariams. Įvardytos aplinkybės autoriui straipsnyje leidžia kelti ir tyrinėti hipotezę dėl bendro policijos veiklos kontrolės mechanizmo kūrimo, užtikrinančio efektyvų tiek policijos teikiamų socialinių teisinių paslaugų lygį, tiek visos policijos sistemos funkcionavimą. ENThe article analyses the concept of police actions, their control, and explains the system of subjects authorised to control police actions. It raises three issues: control as a method of ensuring the legality of police actions, the problem of controlling police actions, and the lack of clarity of such. The research subject is control of police actions to compare the results with the goals of the police stated in legal acts and to ascertain why those goals are not implemented. Thus, it is a form of feedback that helps to reveal the basic practical problems and shortfalls of police actions and to eliminate them. The goal is to reveal the rationale behind police actions control and the unclarity of such at theoretical and practical levels. Several factors suggest that developing a unified control mechanism for police actions will ensure both the effectiveness of socio-legal services rendered and the overall functioning of the police system. Control of police actions is defined as a system of supervising and inspecting the actions of police institutions and officers by identifying deviations from these actions, and eliminating them to restore the rights breached and to prosecute guilty officers. The system of subjects authorised to control police actions and their competence is comprehensively discussed. Constant monitoring is judged to be the most effective way to implement police control. In conclusion, the ratio of control over police actions and of the lack of clarity of such is due to a combination of socio-political, socio-economic, socio-juridical and socio-technological factors in the public security infrastructure.
